Terms and Conditions for Drivers

1. General Terms
1.1 Agreement: By using the Mint Driver App, you agree to abide by these Terms and Conditions, including any amendments or updates. If you do not agree with these terms, you are prohibited from using the app.
1.2 Modification of Terms: Mint Services Oy reserves the right to modify these Terms and Conditions at any time. You will be notified of any significant changes, and continued use of the app constitutes acceptance of the updated terms.
2. Mint Driver Account
2.1 Registration: Before using the Mint Taxi Services, you must sign up by providing the required information in the registration application on our website and uploading any necessary documentation as requested by Mint Services Oy. Upon successful completion of the registration process, we will provide you with a personal Mint Driver Account, accessible via an email and password.
2.2 Driver Information: You represent and warrant that all the information you provide is accurate, complete, and truthful. You agree to keep your account information up to date at all times.
2.3 Account Security: You are responsible for maintaining the confidentiality of your login credentials and agree not to allow any other person to use your Mint Driver Account.
2.4 Use of Services: By using the Mint Driver App, you agree to comply with all applicable laws, regulations, and rules governing passenger transportation services in the jurisdiction where you are providing such services.
3. Driver Responsibilities
3.1 Vehicle Requirements: You are responsible for maintaining a safe, roadworthy vehicle that meets the standards set by local authorities. The vehicle must be in good condition and suitable for providing passenger transportation services. Your vehicle must be approved by Traficom for taxi use and registered for licensed taxi use.
Car model year requirements:
Mint Class: Vehicle must not be older than 2010.
Comfort, Luxury, Large and Van classes: Vehicle must not be older than 2015.
Mint Lite class: Vehicle must not be older than 2005.
3.2 Insurance: You are responsible for obtaining and maintaining adequate insurance coverage for your vehicle and passengers. Mint Services Oy does not provide insurance for drivers.
3.3 Driving Conduct: You agree to drive safely, respectfully, and in compliance with traffic laws at all times. You must avoid any behavior that could jeopardize the safety or well-being of passengers or other road users.
3.4 Passenger Confirmation: It is your responsibility to confirm that you are picking up the correct passenger by verifying the passenger's name and ride details (e.g., pick-up location, time, and vehicle description) as indicated in the Mint Driver App. Failure to confirm the correct passenger may result in a dispute or complications, for which you are solely responsible.
3.5 Passenger Damage or Staining: If a passenger causes damage to or stains your vehicle, you have the right to request compensation from the customer for the repair or cleaning costs. Mint Services Oy is not responsible for covering these costs.
3.6 Emergency Situations: In the event of an accident or medical emergency during a ride, you are required to immediately ensure the safety of the passenger and contact emergency services if necessary. You agree to cooperate fully with emergency responders and provide any necessary information to authorities.
4. Driver Compensation
4.1 Commission: Mint Services Oy will charge a commission fee of 15% for every ride completed through the Mint Driver App. The remaining amount will be paid to you as earnings for the services provided.
4.2 Payment: Payments will be processed through Mint Services Oy using external payment processors. Payment details, including the breakdown of your earnings and commission, will be made available to you directly in the Mint Driver App.
4.3 Incorrect Bank Details: Mint Services Oy is not liable for any incorrect money transactions in case you have provided incorrect or incomplete bank account details. It is your responsibility to ensure that your bank requisites are accurate and up to date to avoid payment issues.
4.4 VAT and Tax Obligations: As an independent contractor, you are responsible for managing your own tax obligations, including but not limited to VAT (Value Added Tax) or other applicable taxes, as required by local tax laws. Mint Services Oy is not responsible for any tax obligations incurred by the driver during the provision of services through the Mint Driver App. Drivers should consult with a tax professional to ensure they comply with all relevant tax laws and regulations.
4.5 Non-Payment by Rider: As a driver, you acknowledge that Mint Services Oy is not liable for any unpaid fares if a rider fails to pay. The responsibility for payment lies with the rider. If a rider does not pay, you must report the issue to Mint Services Oy immediately through our email. Mint Services Oy will review the situation but will not be liable for any unpaid fares.
5. Pricing and Surge Pricing
5.1 Price Adjustments: During periods of high demand, prices may increase due to Surge Pricing. Surge Pricing is determined by factors such as ride demand, weather, traffic, and other variables.
5.2 Fare Calculation: The fare for each ride is calculated based on the following components:
Start Fee: A fixed fee charged at the beginning of each ride.
Minute Fee: A charge for the duration of the ride, calculated per minute.
Kilometer Fee: A charge based on the distance traveled, calculated per kilometer.
Minimum Fee: A minimum charge applied to ensure that no ride is below a certain amount, regardless of the time or distance.
6. Ratings and Feedback
6.1 Rating System: After each ride, passengers will have the opportunity to rate their driver. This feedback helps improve the quality of services and ensures mutual respect and accountability. Drivers are encouraged to maintain high standards to receive positive ratings.
6.2 Action on Poor Ratings: If your ratings fall below acceptable standards, Mint Services Oy may take actions such as restricting access to ride requests, suspending your account, or terminating the agreement.
7. Downtime and Unavailability
7.1 App Downtime: While Mint Services Oy makes reasonable efforts to ensure the Mint Driver App is available at all times, there may be periods of downtime or unavailability due to scheduled maintenance, updates, or technical issues. During such times, the driver may not be able to access the Mint Driver App or provide transportation services.
7.2 Scheduled Maintenance: Mint Services Oy may conduct routine maintenance or updates on the platform. Drivers will be notified in advance of any planned downtime or updates. However, in case of unexpected technical issues or emergency maintenance, there may be periods of unavailability without prior notice.
7.3 Impact of Downtime: During any period of downtime or unavailability of the Mint Driver App, drivers will not be able to accept ride requests. Mint Services Oy is not responsible for any loss of earnings, delays, or inconvenience caused by such downtime. Drivers are encouraged to check for updates regularly.
7.4 App Updates: It is the driver's responsibility to regularly check for updates to the Mint Driver App and ensure that the app is always up to date. Failure to update the app may result in performance issues or the inability to access certain features of the service, for which Mint Services Oy is not responsible
8. Communication with Mint Services Oy

8.2 Response Time: Mint Services Oy will make reasonable efforts to respond to driver inquiries promptly. Response times may vary depending on the nature and urgency of the inquiry.
9. Data Privacy and GDPR Compliance
9.1 Compliance with GDPR: Mint Services Oy is committed to protecting your personal data and complying with the General Data Protection Regulation (GDPR). We collect and process personal data (such as your name, contact details, and driver information) to provide and improve the services offered through the Mint Driver App. Your data may also be used for the purposes of service improvement, analysis, and communication related to the Mint Taxi platform.
9.2 Data Usage: By using the Mint Driver App, you consent to the collection and use of your personal data as outlined in our Privacy Policy. We will ensure that all data is handled with strict confidentiality and in compliance with applicable data protection laws.
9.3 Data Access and Updates: You have the right to access, update, and delete your personal data at any time. You can update your account information by contacting us via email.
10. Limitation of Liability
10.1 No Liability for Faults or Damages: Mint Services Oy is not responsible for any faults, damages, or losses incurred during the provision of transportation services by drivers using the Mint Driver App. This includes, but is not limited to, damages to the vehicle, accidents, injury, loss of property, or any other incident that may occur during the ride.
10.2 Driver Responsibility: The driver is solely responsible for the safety and condition of their vehicle, ensuring that it complies with all local laws and regulations and is in good working order. Mint Services Oy assumes no responsibility for the actions, behavior, or decisions made by drivers during the course of a ride.
10.3 No Warranty for Service: Mint Services Oy makes no warranty or representation regarding the availability, quality, or reliability of the Mint Driver App or the transportation services provided by drivers. Mint Services Oy does not guarantee the performance or availability of the app, nor does it guarantee that any ride will meet the expectations of passengers or drivers.
11. Indemnity
11.1 Driver's Responsibility for Claims: The driver agrees to indemnify, defend, and hold harmless Mint Services Oy, its affiliates, employees, agents, and representatives from any and all claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of:
The driver's actions, omissions, or conduct during the provision of transportation services through the Mint Driver App;
Any damage, injury, or loss (including death) caused to passengers, third parties, or the driver's property during the course of the ride;
Any failure by the driver to comply with applicable laws, regulations, or these Terms and Conditions;
Any disputes with passengers or third parties related to the ride, including but not limited to claims of personal injury, property damage, or theft.
11.2 Scope of Indemnity: The driver's indemnification obligations under this clause apply regardless of whether the claim arises during the ride, in connection with the use of the Mint Driver App, or as a result of the driver's interactions with passengers or third parties. The driver is responsible for handling, defending, and resolving any claims brought against them or Mint Services Oy, including legal proceedings, settlements, or other actions taken by third parties.
12. Termination and Suspension
12.1 Termination by Mint Services Oy: Mint Services Oy reserves the right to suspend or terminate your access to the Mint Driver App at any time, with or without cause, if you violate these Terms and Conditions or if it is deemed necessary for safety, security, or operational reasons.
12.2 Termination by Driver: You may terminate this Agreement at any time by ceasing to use the Mint Driver App and notifying Mint Services Oy.
13. Governing Law and Dispute Resolution
13.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Finland.
13.2 Dispute Resolution: Any disputes arising out of or relating to these Terms and Conditions shall be resolved through arbitration in Finland, unless otherwise agreed by both parties.
14. Miscellaneous
14.1 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Mint Services Oy regarding your use of the Mint Driver App and supersede any prior agreements or communications.
14.2 Severability: If any provision of this Agreement is found to be unenforceable or invalid, the remainder of the Agreement shall remain in full force and effect.
15. Independent Contractors
15.1 Independent Contractors: The driver is not an employee of Mint Services Oy. Drivers are independent contractors who use the Mint Driver App to connect with passengers. As such, the driver is responsible for their own business operations, including vehicle maintenance, insurance, and compliance with all applicable laws and regulations.
